What is a Background Check?

The question is like asking what is a Car? There are so many makes and models, it can be difficult to understand. How do you conduct a "physical search" on someone's background? Doesn't this interfere with privacy laws? It seems like going too deep into a person's private life might be against some of the HR laws designed to prevent employers from discriminating on the basis of sex, age, or some other issue. Is this true?

Hiring a new worker seems to be an experiment every time. There is no lab manual to follow if the employer is not allowed to investigate a potential employee to determine if the experiment is going to blow up in his face or be a success.

Sex, age, and all those demographics are not in the lab manual, but drug use, dishonesty, and unreliability are serious questions. It appears that regulations restrict the ability of an employer to discriminate against the real serious questions.
